The buying and selling homes, houses, buildings, lots- real estate in general that is, can be daunting for many- Especially in the absence of Real Estate Agents / Realtors or Brokers.

Below is a short list of the most common questions we are asked as it relates to our Real Estate Investing objectives that we hope will augment your understanding of our industry. Of course, if you do not find your answer here, you can always ask a question of us on our contact page. We'll do our best to get back to you as soon as we can.


1) Is what IndyBuySell.com is doing legal?

A: Yes, absolutely. There is nothing in Indiana State or federal Law that prohibits individuals or businesses from lawfully purchasing or selling/renting Real Estate independent of agents and / or brokers (see FAQ #2).

2) But, don't you need a license to buy or sell real estate in the State of Indiana?

A: Nope. That's a popular myth, for ALL states as we understand it. Unless, that is, you are performing services "for another" and for compensation.

Specifically, Indiana Real Estate Commission Laws and Regulations 2008 code (ยง 25-34.1-1 (.pdf)) defines Real Estate "Salespersons" and "Brokers" as individuals, partnerships, corporations and limited liability entities who, for consideration, sells, buys, trades, exchanges, options, leases, rents, manages, lists, or appraises real estate or negotiates or offers to perform any of those acts.

The phrase "for consideration" in that definition means "for another" in exchange for something of value.

We purchase real estate for ourselves only and we sell, rent and market only those properties in which we have legal control. We do not act on anyone else's behalf in the above type of acts and as such, do not require a license. This has been positively confirmed (and a matter of public record) at our appearance in front of the Indiana Real Estate Commission as recently as July 13th, 2011.

3) If I contact you to buy my house / real estate, are you obligated contact me or purchase my property?

A: Sorry, no. We are no more immediately obligated to purchase your real estate property(ies) than you would be automatically obligated to purchase/rent any of ours.

We only buy real estate that meets our investment goals. We simply cannot purchase those properties that we determine are likely poor investments. If we have not contacted you it probably means that either you have entered invalid contact information or that we are extremely busy or have determined that your property does not currently meet our investment needs.

4) What if I do not like / accept your offer(s)?

A: That's okay, you are absolutely free to do so. We cannot, nor would we even try to force you to, do anything you have not agreed to under contract.

5) I don't understand your offer / agreement / contract. What should I do?

A: Every time we submit an offer to buy or sell any property, we always recommend that all parties involved consult a competent real estate attorney as you would a mechanic if you are contemplating the purchase of a vehicle. In fact, as we have nothing to hide, we encourage it!

Any entity seeking to engage in good business practices wants to do right by their customers / clients and we are no different. It is not our intent to have customers / clients enter into agreements that they do not understand. Full understanding of the terms of any agreement entered into, by both parties, is of paramount importance to us.

It's important to note here that it is always a bad idea to rely on verbal statements / agreements. Understanding and agreeing to written terms is the best practice in our opinion. Thus, we make every effort possible to make clear our intent whenever written.
